Following the recent publication of the UK's definitive Regulations
under the EC WEEE Directive (The Waste Electrical and Electronic
Equipment Regulations 2006 - freely downloadable as
http://www.opsi.gov.uk/si/si2006/uksi_20063289_en.pdf) we are trying
to determine whether we are required to comply with respect to the
products we manufacture and/or market.
Our main products are electrical equipment for professional/industrial
use, particularly mains voltage stabilisers (regulators), UPS, and power
transformers and resistors. We also market (stand-alone) standards,
calibration and testing instruments.
As far as we can see, these products fall into none of the ten
categories set out in Schedule 1 to the Regulations, and therefore
Regulation 5 (3) (a) applies, which states
"(3) These Regulations do not apply to EEE -
"(a) that is part of a type of equipment to which paragraph (1)
does not apply;"
In these circumstances we seek advice as to whether our interpretation
is correct, whether we are required (or recommended) to register, and
whether excluded EEE should be marked with the "crossed wheelie bin".
(I recall that when CE marking first came in there was a lot of
discussion as to whether equipment for which CE marking was not
mandatory could be so marked if the customer insisted, or whether it
was actually illegal to do so.)
Sorry if this is somewhat off-topic, but as many compliance people
deal with other areas alongside EMC, I hope it is OK to ask - even to
find a more appropriate forum.
