Christine / All, There were some good responses from the group but I don't think anyone has answered your direct question. Yes, there are definitely legal scenarios where someone may purchase your product in Mexico without having the NOM certification on it. * A Mexican corporation can buy your product directly from your US location without having NOM. There are several conditions that need to be met but the most important one is, the Mexican business must be a S.A. de C.V business and must import the product themselves into Mexico. * Another Scenario would be your US Office may allow your Mexico Office to import the product directly from you. ( For example Company XYZ USA can deliver it's products to Company XYZ Mexico ) Your Mexico office would also need to be a S.A. de C.V business and must import the product themselves into Mexico. * There are several other requirements and conditions to the above options ( I can't remember all of them off the top of my head) which are all legal. Some requirements are only for special High Technology Equipment in which there is no applicable NOM. There is also exceptions made for products that are non-commercial and will not be sold to consumers. Or for equipment that will be part of a "Public Utility" such as "SOME" Telecom equipment or equipment used in a Public Power Station/Grid. So your customer is correct if the above conditions can be met but you must be sure that YOUR company knows what they are doing. If your company misses any of the conditions or requirements that allow a waiver to the NOM, you will be penalized financially for it.....usually long after the violation occurred.
