Could anyone with insight into the means in which energy efficiency
requirements are regulated within the US articulate the process so that
we might be in a better position to determine the impact of the ESIA
2007 amendments?
Our understanding of the impact of the amendments under ESIA 2007 is as
follows:
1) First, sec 301 a) amends the definition of an External Class A
power within the Energy Policy and Conservation Act 42 U.S.C. 6291
supply.
2) Secondly Sec 301 b) amends Energy Policy and Conservation Act 42
U.S.C. section 6295 to include the test procedures to be applied to
Class A external supplies.
3) Thirdly sec 301 c) amends the Act. 42 U.S.C. 6295(u) to include
a section 6 that identifies a performance standard for the class A
supplies and indicates:
":a class A external power supply manufactured on or after the later of
July 1, 2008, or the date of enactment of this paragraph shall meet the
following standards: etc..."
What is unclear is the impact of the proceeding section (4) which
indicates that any standards set under the subsection (assume 42 U.S.C.
6295) are applicable products manufactured or imported 3 years from the
date of issuance.
(4) Any energy conservation standard issued under this subsection shall
be applicable to products manufactured or imported beginning on the date
that is 3 years after the date of issuance.
A few specific questions come to mind:
1) The role of the standards, is this the means in which the
efficiency requirements are defined/enforced? In other words no standard
no requirement.
2) If so then does it not appear that the efficiency standards
defined under 301 c) come in to force three years after their issuance
as per section 6295 (u) (4) which I understand would be at the earliest
