Replacement battery packs are sold standalone. There are also 3rd party
battery packs that are not evaluated together with the end product by the end
product manufacturer, and are therefore not included in the end product CE
declaration.

My experience has been that notebook computer battery packs from the notebook
manufacturers always carry the CE mark.

Li-ion batteries aren't generally sold as products, they are components. 
Wouldn't it be true that as a component the final assembly/product would need
a CE mark, additionally it would be not appropriate to CE mark a battery as it
is a subassembly or component?

An off-the-wall question. It is my understanding that all Lithium Ion
batteries (or other smart batteries) have digital circuitry in the for
monitoring over-temp, etc during the recharging process. Do these batteries
need to carry a CE marking because of this circuitry?
