Replacement battery packs are sold standalone. There are also 3rd party battery packs that are not evaluated together with the end product by the end product manufacturer, and are therefore not included in the end product CE declaration.
My experience has been that notebook computer battery packs from the notebook manufacturers always carry the CE mark.
