Charlie, You are asking the wrong people. Having your product NRTL listed is the safe way to go, but if there is some reason to avoid that, it all depends on what your customer requires.
Our company sells to many US federal and state government locations. Most of the federal locations we have sold to do not care about NRTL, but some do. Years ago we sold an instrument to the federal government and they did not care about NRTL, but then they were relocating to where it was required. In that case, we had the instrument shipped back to us, we had an NRTL Field Inspection performed, the product was labeled and returned to the customer. US State organizations almost always require NRTL (labeled) even in cases where it is not required to be NRTL Listed, such as in the case of Custom products. In this case, which isn't unusual in the US, the State's requirements exceed those of the Federal government. Many large cities in the US pile on the madness at well, but we won't get into that here. If you are familiar with what is "acceptable" as per 29CFR1910.399, then you know there are three ways to legally satisfy OSHA. However, it all comes down to making the sale. Soooooo the best answer to your question is, "it depends on what your customer requires". Or, get NRTL certification on your products and you won't have to worry. Have Fun. The Other Brian ----------------- All Do OSHA requirements also apply to the US Government itself as an employer? - i.e. do they require equipment to be "acceptable" as per 29CFR1910.399? The reason I ask, is that equipment solely for use by US Government is exempt from FCC rules, I was just wondering whether there was a similar exemption for safety. I'm guessing not, but wanted to check. Or, re-phrasing the question "if you were planning on selling a mains powered CE marked product to the US government (and not other organisations within USA), should you plan on getting it NRTL listed first?"
