There is no legal penalty for over warning for Cal Prop 65, so you should be fine.

I have what might be thought of as an unusual situation, or maybe not.  

For rechargeable battery packs, it is appropriate to use Prop 65 Labeling in a general sense regardless of the actual chemical content of the device?   Stated another way, if a device has labeling stating may contain lead and it does not, is this a problem?
