Thanks Charlie.  We used Technology International in the late 1990s for our CB. 
 They also stored all our TCFs too, since those had to be held by someone in 
the EU.

“Competent Bodies” was the term for 3rd party assessment bodies under the 1st 
EMC Directive, 89/336/EC that came into force in 1996, and they were required 
where Harmonised Standards weren’t fully applied.

 

The 2nd EMC Directive, 2004/108/EC, replaced the term Competent Bodies with 
Notified Bodies, and their use became optional.

This prompts me to ask if there is a distinction between a Competent Body and a 
Notified body.

 

I recall that CB was, at one time, required if the Technical Construction File 
route to compliance with the LVD and EMC directives was pursued if for example, 
generic standards were applied.

The use of a NB is always voluntary under the EMC Directive, irrespective of 
whether Harmonised Standards are applied or not.

 

Due to complications in making Harmonised Standards provide a “legal” 
presumption of conformity, following the James Elliott court case, we are left 
with the situation where there a number of HS that are quite old.

 

It is always  up to the manufacturer to conduct a Risk Assessment which 
includes the intended use of the product and decide whether it better to apply 
HS standards or newer published standards that might (would) better represent 
“state of the art”

EN 50491-5-3:2010 was listed in OJ and classified as a harmonized standard 
(EMC).

 

Then it was superseded by ​EN IEC 63044-5-3:2019 with DOW 2026-11-01.

According to CEN / Cenelec web, regarding to Citation in OJEU, it is written 
“No citation expected for Directive 2014/30/EU”.

 

1. EN 50491-5-3:2010 is still listed in the latest EU list of harmonized 
standards, so it still a valid standard for self-declaration?

2. EN IEC 63044-5-3:2019 is not listed as a harmonized standard, and we should 
therefor expect to consult a Notified Body for compliance. Right?

3. Is it expected that EN IEC 63044-5-3:2019 will be listed in OJ after the DOW 
date?
