Noel. Your A&P is right. If required by type certificate or FAR, TSO'd instruments should be used.
I can not find a mention of TSO'd instruments in our Type certificates, nor did anyone find a FAR rule that would state such requirements for our airplanes. A VSI was not even standard equipment when Ercoupes were delivered. He also said the non-TSd'd instruments were made mostly in China and couldn't be overhauled or repaired. The instrument in question for me was a VSI I wanted to install.
