I would say it is totally legal and desired to upgrade your elevator this way. 
Ercoupe Service letter number two recommends installing the split elevator in 
early type model Ercoupes.
This was when installing something proven with factory recommendation did not 
require a revolution in the approving Office.
 
 
In an earlier post Paul reported the following:

STC that mentions the split elevator in a 415 CD
 
I would think that it is a good time to upgrade the C model to a CD model at 
that time. The Split elevator is IMHO meant to be on a 415 CD
