to Garmin Support and they email'dm me the following which fixed the

Thank you for contacting Garmin International.

There are a couple of troubleshooting steps that may solve the satellite
reception problem.
 
You may want to check the software version on your 396 to see if an 
update is available. The current software version is 4.50. The version 
on your GPS will show up briefly in the lower right hand corner of the 
screen during the boot up process when you first power the unit on. If 
the version on your GPS is anything other than 4.50, I would recommend 
updating. The update file can be found on the Garmin web site at the 
following link:

If you have not updated your GPS previously on the computer that you 
will be using for this update, you will need to download the USB Drivers
file first. This file is on the above link near the bottom of the screen
(USB Drivers March 26, 2007).  Next, download the software update 
(GPSMAP 396 June 26, 2008) on the above link.
 
After you have completed the software update, please do the following:
 
Start with the GPS in the OFF position.  While OFF, depress and hold 
down the "OUT" button.  Power the GPS ON.  Once the screen begins to 
illuminate, release the power button, but continue to hold the "OUT" 
button down for about 15 seconds.  After 15 seconds, release the "OUT" 
button.  Press the "ENTER" button to get past the agreement screen.  
Press the "MENU" button twice.  Use the arrow rocker switch to highlight
the "GPS" icon.  The top of the screen should display "AutoLocate".  
Place the unit outside with a clear 360 degree unobstructed view of the 
sky.  This will allow the GPS to rebuild a new almanac data file.  This 
is the information that tells the GPS where to look for the orbiting 
satellites.  Establishing a new almanac will often correct satellite 
reception issues.  This process may take up to 30 minutes to complete.  
When the GPS displays several green satellite bars and the correct date,
time and location, the process is complete.
