Well here's the response I got from Jesse Aratow - New Projects 
Development, Financial Management at SCI's label, SCIFidelity:

I guess at this point there's nothing to worry about anyway since spring 
tour doesn't start for 2 more months.

I realize that it is SCI's position to continue to allow fans to audio
tape and trade their upcoming spring tour. What is not clear is if the band
will allow the "official" cds to also be copied and traded. While I realize
that the obvious answer might be no, another band (Pearl Jam) who also
sells cds of their concerts does allow fans to trade recordings of what the
band is selling. Regardless, I'm looking forward to these releases and
hoping the project goes well.

tour bootlegs was "Trade 'em...we don't care."  Simple, easy to understand, 
no bs, no confusion...

I would assume SCI's official releases would be non-tradeable UNLESS they 
specifically say that trading the shows is OK.
