I'm all for Screw The Establishment(TM), but on spam control I am willing
to hedge a little bit on the details of my freedom for the public
wellfare. To define my thinking a bit by example:
- You have a right to say what you want, but others have the right to
hold you accountable for what you say. The government does have the
right to limit speech to the effect that they may do so in other
venues: Free speech is not an adequate defense for charges of fraud,
for example.
- You have the right to send mail that is deliberately anonymous, though
the government should be free to pass legislation making it illegal for
you to misrepresent who you are in electronic communications. (ie,
they may make it illegal for me to be Bob Miller since I am not he or
I'd have quietly leaked the series2 remote code and EEPROM passwd by
now.. This may mean that they will require email that is anonymous to
carry prominent indication (from field for example) that the sender has
chosen to not name himself..)
- The government has the right to ammend the legislation regarding
sending of "junk faxes" to cover other electronic communications such
as cellular phones and email where the cost of advertising is a burden
on the recipient rather than the advertiser. If this means absolutely
no unsolicited commercial mail will be tollerated, then I am all for
the costs of enforcement coming out of tax dollars.
- It should be a crime to knowingly spread false information to the
masses in the hope that they will buy into it and do something they may
not otherwise do. You need never fear the government will enact such a
law, however, since the impact to US politics would be devastating -
far more so than it would be to that class of spammers.
