This is what I've been wondering about too. Maybe the lawyers that are
saying to put the disclaimers on e-mail messages should be notified of
this?

This is BS.  If you are dealing with confidential information, you treat
it as such.  Unless encrypted, e-mail is transmitted over the Internet
in clear text.  You don't mail confidential documents in transparent
envelopes, do you?  If you can't risk the viewing of the information by
unintended recipients, you don't use simple e-mail to send it.  There
are specialized products out there (like Tumbleweed's Redirector) that
are designed to do this sort of communication.

If you goof up, the disclaimer can't save you.  If you send confidential
company information to a competitor by accident see how fast your
company fires you, even if you had a disclaimer.

Accidental breach of confidentiality: If an employee were to receive a
confidential mail from someone and by accident forward it to the wrong
person, the employee, and therefore the company, could be liable. This
can easily happen. For instance a wrongly addressed e-mail can be
forwarded to a postmaster, who might not be authorized to read the mail.
Furthermore, e-mail can easily be intercepted. If you include a
statement at the end of your mail that the message is only intended for
the addressee, and that if anyone receives the e-mail by mistake they
are bound to confidentiality, this could protect you. ........ etc.
