Hi Lucylou A very similar experience to my own - it happened to me last March. I did them again and got three in October. I think that you need to weigh up the costs of recheck (€120 each i think) and if you can afford it and think you did a lot better then give it a go. The most someone that i know has been upgraded is by 10% - although someone elsewhere on this forum said they went up by 20%. My friend appealed the because she had the other seven - if you look at some of the docs the law soc send out they say they have a results committee that look at your overall performance and take that into account. Maybe that was a factor, maybe not. I didn't bother because I'm one of the cynical ones who think that my money would be better spend on the next round then paying for a recheck that has no transparency whatsoever. Its really a cost-benefit thing and only you can weight that up.
On the appeal the extern examiner will do the re-check - if you got a result that was close to passing already then the extern would have already looked at your paper. Any result that is within a couple of percent of passing or failing has to be sent to the extern for validation - as does a random sample of the other papers. If the extern is someone's old lecturer somewhere then you can see if someone here has studied under them and ask if they are hard markers or whatever. It shouldn't be a factor in what should be an objective appraisal but I think that may be enough to edge a 50/50 appeal into one thats worth a punt. Don't get too disheartened - I was the same before - it's tough when you put a lot of work in and make a big sacrifice but the study you did will stand to you.
