Yes, the latest rsyncX package still overwrites the Apple installed /usr/bin/rsync and adds some other stuff to both /usr/bin/ and /usr/local/bin as well as a "helpful" application in /Applications/Utilities.
However, I believe 'fink selfupdate-rsync' in the latest release fink works with rsyncX too. I actually installed rsyncX and made changes to the fink code to deal with it. (specifically: "--nohfs" flag to the rsync command iirc).
