This seems to be the real problem. I am not sure how it can happen, 
because when the PatchScript is run, it starts a shell using

#!/bin/sh -ev

and this should not read any startup scripts, so that the PATH should be 
set as Fink wants it, with /sw/bin coming before /usr/bin. Or (evil 
suspicion) does Fink perhaps not run init.sh before executing the 
PatchScript?
