. City Council passing gun control legislation and threatening to sue the
Legislature in order to enforce it.

Only state lawmakers have the right to enact firearms laws in Pennsylvania.
But with 137 homicides in Philadelphia so far this year, Councilman Darrell
Clarke said the city had to do something.

City Council will soon file a lawsuit in Common Pleas Court against the
General Assembly to give the city the authority to pass its own gun laws .

No telling what the actual arguments to the court will be until filled, but
it appears on the surface that Philly is suing the state of Pennsylvania for
"negligence".  Can anyone explain what case the city would make?

Asked how Council can move forward on the bills without a 
state enabling law, Clarke said, "We think that with our 
complaint, we will show in our theory that the state has been 
negligent in terms of enacting good-sense legislation. We think 
we have a compelling case."
