The reporter responds that the Appeals Court allowed the case because  
they felt that the promises made to the victim by police were so  
specific as to lose them exemption under the public duty doctrine,  
including Lynch (a NC case), despite the defense arguing most of the  
usual suspect precedents.

If the victim wins this one, we won't learn much other than where the  
"specific promise" line is located in North Carolina, but if she  
loses this one as dozens of other victims have before her, it should  
hopefully wake a even more complacent people up.
