I wonder what impact this may have on the Chicago case.  Clearly it doesn't
apply in their district, and as Eugene's analysis
(http://volokh.com/archives/archive_2009_04_19-2009_04_25.shtml#1240254351)
indicts the odds of the case going up the judicial food chain is low.

But I have to imagine that the City's lawyers are reading this with interest
and worrying somewhat about their odds of success.
