Intellectual bankruptcy can only hide behind "judicial courtesy" for so long. The written Constitution is meaningless to the "Liberals" on the Supreme Court. As Justice Thomas once said "they make it up as they go." I think Justice Scalia just reached the breaking point with Stevens. ***************************************************************************************** Professor Joseph Olson, J.D., LL.M. o- 651-523-2142 Hamline University School of Law (MS-D2037) f- 651-523-2236 St. Paul, MN 55113-1235 c- 612-865-7956 [email protected] http://law.hamline.edu/node/784
>>> "Guy Smith" <[email protected]> 6/28/2010 2:40 PM >>> Perhaps I simply have read too few decisions by the Supremes, but Scalia mocking evisceration of Stevens’ dissent seems exceptional. Granted Steven’s opinions have recently entered the realm of science fiction, but Scalia’s assault treats Stevens (rightly) with a very heavy hand.
