Posted on June 1, 2011 by A few weeks ago the Second Amendment suffered a setback in the Ninth Circuit. In Richards v. County of Yolo, District Judge Morrison England issued summary judgment against a challenge to the California county’s permitting process for carrying a concealed weapon (click here to read the full opinion). This is not my first critique of an opinion by Judge England, and the way his Second Amendment analysis parallels his First Amendment analysis is telling: it seems the Bill of Rights only protects Americans when life becomes really, really inconvenient, and that anyone who has made it to court seeking such protection is probably not endangered enough to warrant it. http://wyliberty.org/highlight1/is-the-second-amendment-merely-a-pesky-carve-out/ -- Charles Curley /"\ ASCII Ribbon Campaign Looking for fine software \ / Respect for open standards and/or writing?
