Well not exactly.
IF someone is using your equipment or service to commit a crime and
IF you become aware of it and
IF you do nothing about it THEN you are derelict and can be held liable.
A bank can be charged with money laundrying for accepting large cash
deposits without questioning the source. Why? They didn't sell
any drugs or participate in any criminal activity, just provided the
criminal with a service. However, their services did facilitate the
criminal's activity
and they made no attempt to prevent that.
Managers can be held responsible if they do nothing to correct sexual
harassment. A commander can be held responsible for
the action of his troops in time of war if he does nothing to stop their
violations of the Geneva Convention or other criminal conduct.
Just one final point. If I am following your reasoning correctly then you
wouldn't consider it wrong to provide services to someone
hosting a child pornography site. Is that correct? Service providers can
take some pretty modest steps to reduce the effectiveness
of hackers, script kiddies and spammers. Many do. Others would prefer to
turn a blind eye. Trouble is that any industry that does not
regulate itself will soon find the government doing it for them.
