Not to pick on Scott here, but what does this have to do with Firewalls?
Surely there is a Linux/Windows pissing contest mailing list somewhere that

basically, it is not legal for linus to sell linux because it is distributed
under the GPL .. so your question is not as rhetorical as you might think ..
and if you want to develop the kernel, by all means, dive in .. the source
code is publicly available
