it seems you're not exactly correct here:

to me it seems like when sthe scrolling container reaches maxScroll, the flashplugin seems to fire the scroll event (back) to the browser.

at least this is what it seems to me. it might be considered as a feature if you want to, if you think of how html-scrollcantainers behave.
