Well they seemed to have cleaned up the versions you can download from the html-page http://opensource.adobe.com/wiki/display/flexsdk/Download+Flex+4.5 (There used to be a lot more versions) but it seems it's still an official versin (I checked when it upgraded to it) you can also download it: http://fpdownload.adobe.com/pub/flex/sdk/builds/flex4.5/flex_sdk_4.5.0.20967.zip so I guess there should not be any NDA issues.
