I found a temporary solution/hack. I took out the doctype and flash displayed as normal. What's odd is that it was ok with it for a while.  But it did work for a while as it was. (no cvs, svn at this project).

<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional//EN" "http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd">

FYI I'm merging my flex project swfs into an jsp page so theres all this other crap all over the place.
