As I understand encoding, the XML file would only be "correct" if all characters are UTF-8. However, if you indicate 'encoding="UTF-8"', but it contains UTF-16 characters, then it's not really UTF-8, it's UTF-16. The encoding is not necessarily what it says. For example, I could tell you I am Marilyn Monroe, but until you check my DNA you'd never know. I could've had plastic surgery (and a couple of... uh... other operations) so that even if you saw me clean-shaven, you might not *know* ;-)

I don't know of a tool for checking the encoding of characters (perhaps XMLSpy at http://www.altova.com/ or BBEdit at http://www.barebones.com/) You could try opening your file in one of these and it'll tell you if the file is properly encoded.
