If you were to follow the same assumption, phreakers would be termed as crackers by your definition. They don't follow the terms and conditions/rules, yet when you look back at history true computer hacking started with phone phreaking. Bottom- line is, you might be confused in what is illegal and what is hacking. Don't misuse the term illegal with cracking.
