I don't have the time to read through the verbiage again, but IIRC yes. Any submission to Fossil has to go with full assignment of copyright, which has to be done by the original author. This way it was possible to make the move from GPL to BSD... But some code from the early days, when no contracts were signed, had to be dropped.
