Most likely, even if you could get an NDA, you won't be able to use that info in FOSS programs - which makes the point moot. One way could be to get Linux Foundation to enter into NDA with Validity: http://www.linuxfoundation.org/programs/developer/nda I don't know if they have this program only for kernel related stuff or even user-space programs can be covered under it.
