Dear friends and neighbors,

I am not familiar with the precise geography - borders, etc., here. However,
two ideas come to mind. 1. The evidence needs to be photographed by a Twon
Official, and the Town Attorney, Chris Petrini, needs to be supplied with it
immediately to determine if a Cease and Desist Order can be obtained from a
Court today. Mr. Petrini can than analyze what criminal charges can be
brought. 2. The other side is private action. Abutters must also take
pictures, contact the Middlesex News, perhaps Rob Haneisen, to publicize the
owner's actions and their deleterious effects, perhaps hire a private
attorney to sue for damages. Also, and again I don't have personal knowledge
of the space and detail, it is very important to be right about this. TO be
wrong and publicize it could be interpreted as liablous (sp?).

This morning at about 7:45AM I got a call from Ben Aronson saying that he
was watching the crew at Wayside Circle ripping the branches off of trees
along the south border of the property. I walked over and saw about three
to five trees along the south border of the property which had had their
branches ripped off. I spoke with the head of the crew at the site and
advised him, per instructions from Helen, that he needed to pass a message
to Chris K to have him call the Planning Board office.

In addition, I checked on the state of the trench where the logs were
buried. The logs have been removed from that portion of the trench that is
visible, but no attempt, as yet, has been made to see how much further the
trench actually extends.

It is very apparent that the current state of things leaves the No Touch
Zone completely obliterated and the No Cut Zone pretty much decimated,
expecially in the center of the south border. I have spoken with Mark
Broeder(sp?) and he will be visiting the site today with the engineering
plans on file.

I was very disappointed with the way in which Chris got away with
threatening Sid at last night's meeting. In addition, I am not comfortable
with Chris not being held as primary for being responsible for the damage
that has occurred. One member of the Board plus the Board Administrator
witnessed exactly what damage happened, and Rich Garvey stood on the road
and watched as the trees were being taken down, and further, Chris was
allowed to declare at the meeting last night that not a single tree was
taken down in the No Cut Zone.

Helen: How much more has to go on before the Board gets into a discussion
on recision? After the neighbors left the meeting last night, George
Harrington remarked that the only thing going for us is the certain
knowledge that Chris *will* screw up again. I'd really prefer to not wait.

I don't have the education to know exactly how this should be handled, but
it is perfectly obvious that the situation is out of control. If there is
anything I can do to help, consider me available.
