Steve & Ben, Thanks for alerting us this morning to the continued cutting going on at Wayside Circle. Chris has been notified and I'm told he is on his way to the site now. I hope to speak with him today and will keep you updated. The building department, not the Planning Board is the agency with enforcement power and Jay of course asked them to get involved before last night's meeting. And we will be hearing more from them today after their visit to the site today.
Last night's outburst by Chris is nothing new to any of us and the PB was certainly not threatened in any way by his statements nor were we snowed by any of his declarations of what was or was not happening on the property. You all know that we can only rely on what is seen by our town staff and board members, not what is said. At this point, even photos are not reliable information. Let me assure you that Chris IS being held as the only one responsible for all damage that has occurred. But it is evident to me that just being held responsible doesn't stop the damage from happening. We've all seen that and continue to see it. That is precisely why I would like to talk directly to the contractor doing the site work. I know it's unorthodox for the board to do so, however, perhaps if the requirements of the decision are known by the contractor, he might think twice before moving ahead with unauthorized work. This is no way suggests that the contractor is responsible....he isn't. But I'm thinking more about stopping the damage right now than how to punish someone. It's one of the reasons that recision is a risky proposition in my mind. Can you imagine what those equipment operators will be ordered to do the morning after a recision? No damage claim could ever repair that. Today we will know more from the building department and perhaps we can learn more from Leslee and her commission after they've seen the site. If there is a legal way to stop the developer from going beyond the terms of his decision, we'll do it. Recision is one way, but it, I fear, could have a monumental environmental cost. But it is an option that the Board will have to consider on Tuesday. Ben, when you have some time, I'd like to talk to you about the specific issue regarding the replacement of an appropriate buffer to your property. I am confident that's an issue that can be worked out to your satisfaction. I will be unavailable tomorrow, but please leave me phone messages or emails and keep in touch with Sue, and I'll be back in touch on Friday. Jay will be in the office tomorrow.
