Unless I’m not understanding the essence of this issue, is enforcement now the critical piece of the puzzle? In other words, whether we have a bylaw regulating earth removal or if it is not permitted by “silence,” if the planning board or other authorities have no tools to enforce it or to go after violations, we are unable to prevent or punish?

I gather from Kathy's memo that we do not allow earth removal anyway something which I recall instituting years ago when it was tried on Edgell Road......

My advice would be to rescind approval of the subdivision on Wayside under C.41S.81W  === Process if the same as it was for approval and impose new conditions relative to restoration of the land, scrubs, trees  stones etc.

Was the Carter Drive a subdivision also or A&R lots...  If the former the same process could and shold go forward.....  we are fiddling while Rome burns.....
