Subject: [massplanners] Hearing Notice for Title V Changes

Acting Governor Swift recently met with the Homebuilders Association and
as a result, instructed DEP to change the Title V regulations to allow 60
minute per inch perk rates and increase the loading to the systems. This
will create a situation where land will become developable that was
previously undevelopable. When these systems fail, which they will in
several years, communities will be faced with either providing sewer
(which many communities either don't have or don't have additional
capacity) or the homeowners will incur huge costs for on-site package
treatment facilities (which they will get tired of paying the electric
bills for and demand sewer). So far, very few people seem to be aware of
these proposed changes. Please forward this public hearing notice to your
board members and other town departments and boards and encourage their on
November 20th. Help DEP to recognize the need to reconsider this proposal
and drop it.

PUBLIC HEARING NOTICE

Notice is hereby given that the Department of Environmental of Protection
will hold a public hearing on proposed amendments to 310 CMR 15.000, the
State Environmental Code, Title 5, promulgated pursuant to G.L.c. 21A,
s.13.

The Department is proposing to increase the allowable percolation rate for
on-site subsurface disposal systems and specifically seeks public comment
on the appropriate effective date for such change to occur.

The hearing will be held as follows:

Wednesday, November 20, 2002 @ 1:00pm

Boston MA

Persons planning to give oral testimony at the hearing are encouraged to
also provide a written summary. Written comments on the proposed revisions
to 310 CMR 15.000 by any person may be submitted to the Department before,
during, or after the hearings, but no later that December 6, 2002, when
the hearing record will close. Requests for copies of the proposed
revisions, or questions about the hearings should be directed to
