Ok, I think that any right-minded free market
proponent could easily see the truth in that (and
many, like myself, may agree with you to some extent).
This point you bring up is (I believe anyway) most
likely the reason that Eric Stahlman and others have
come up with alternatives (I like Eric's Artist's
License myself--on priciple--now if it were only
enforcable.... everywhere).

I agree here also........, the only point I'd like to
state (although I would guess that you, unlike most
people, have already heard this) is that if it doesn't
exist as a separate document and call itself a license
agreement it can't be used to disclaim legal
responsibility in many places. That is the
unfortunate real reason behind most license
agreements...... the inability of some people to
accept the responsibility for the risks that they take
(and for some, on the other hand, not to take
advantage of this). I would REALLY love to be able to
label all of my writings "Please give me credit for
what is mine and have a good time. Any questions,
comments, quips.........to --someplace-- ......
Enjoy," but unfortunately people can't handle a world
based soley on respect and responsibility. Oh well,
if they did we wouldn't be able to deal in a world
based on those ideas either.
