I had this problem with CFTREE. The only way around it is to make a change to the core files.
I heard a while back that they where going to address this issue, not sure if they have yet. I believe there is an issue with cfcontent being used with in FB3. At least I have ran into it every time I have tried to make a fa call that has any cfcontent tags.

Has anybody tried to use CFGRID with Fusebox? A coworker is trying it
and getting an error when the core file transfers variables from the
form scope to the attributes scope. CFGRID creates form variables in a
format that cause the isDefined function to choke:
