IMHO your problem is file system ... you might delete empty partition creating free space, then your ubuntu installer will find empty space to partition with filesystem ext2 or ext3 ... but be careful with bootloader, because I suppose Ubuntu will install grub on MBR: pay attention if launching OS9 is supported, I presume OSX will be, but I read in the list that YABOOT is preferred: I don't have such experience, because I install double boot in a windows system.
