Mac Experts,

I listed for sale on eBay a Mac OS 10.4.3 Tiger DVD that I had
misplaced, and finally found. I bought 10.5 already, so I just wanted
to sell the old DVD. I have the original DVD and the original sleeve.

But eBay took it down, saying they received a request from the BSA to
remove it.

But there are still hundreds (thousands?) of Mac OS DVDs for sale on
eBay.

I get the impression that eBay allows people to sell their Mac OS,
it's fine with eBay, and that BSA must be asking them to remove
specific listings, going thru them one by one, I assume, making the
same request. So eBay is removing the listing, only when BSA makes a
request.

Have you heard of this? I would like to let people know this is
happening.

I'll try listing it again. Can you think of anything I can do to make
it less likely that they would remove mine? Maybe make a statement
that I will provide a document verifying that I own this copy and I
have removed it from my computer? Mac OS doesn't have a serial number
to identify my particular copy.

What are your thoughts?
Thanks,
Bill

Hello, thank you for contacting eBay's Customer Support. How may I
help you?
bill: I posted an item on Saturday and it now seems to be gone. I
can't find it in my "Now selling" listing. Where did my item go?
eBay:
Your item was removed because of a request we received from BSA
(Business Software Alliance) (AS), a member of our Verified Rights
Owner Program (VeRO), asking us to remove the item for: - Software
offered for sale is in violation of an enforceable license agreement,
which constitutes a copyright infringement.
You will need to contact BSA (Business Software Alliance) (AS)
directly at [email protected] with your questions or concerns.

When VeRO participants ask us to remove a listing, they must sign a
legal document stating under penalty of perjury that they own the
rights to the copyright or trademark used in the listing, and that the
items listed infringe their rights. We don't know exactly why the
request to end the listing was made or how to avoid having the listing
ended again at the request of the rights owner. The owner is not
required to provide any specific information about how the listing
infringes. Often, the listing may seem fine to us. However, when we
receive a properly documented Notice of Claimed Infringement, we are
required by federal law to end the listing. That's why we recommend
that you contact the VeRO participant directly with your questions and
concerns.
