It depends on the local Postal inspector or FBI office's workload. Felony theft starts at $500 here in AZ, and this violates federal laws if the perp (or their e-mail address) is outside of the state that Dan lives in. That elevates the crime to wire fraud, which both the FBI and Postal police handle (I'm unsure of where they split the responsibility).
