I can't imagine any public benefit that could accrue from folks knowing 
that killer whales can and do kill people?

I think that the precedent for this argument dates back to the Zapruder film, 
where a private film was held to be of such significance that normal laws such 
as copyright did not apply to it. 

I have trouble seeing that - if these films were made by Sea World patrons - 
that the Zapruder standard for significance will be met. There is probably more 
recent case law I've not reviewed, as I'm stretching a bit just to recall the 
Zapruder holding.

It is also interesting that, while the Zapruder cased trumped an individual's 
right to to do what he pleases with a film that he has made, in that case it 
was for greater dissemination so that all news outlets could carry it. Here an 
opposite goal is desired.
