Helen, I think the question is under item 2 is if an article in its entirety is a substantial part of the newspaper or magazine as a whole.

However, my understanding is that fair use does not extend to reproduction of an entire article. In other words, a quote or a summary is fine, but reproducing the entire article is not. Having said that, it doesn't mean that anybody is going to enforce the copyright. When I wrote for the Times, it was quite common for bloggers to repost articles I wrote with no attribution. I complained about it, but nobody ever did anything about it so far as I know. Newspapers have enough problems without going around suing people who repost their articles on the internet.
