If silk is visible, then the viewed side silk is topmost. Next comes the
active drawing layer, which is equal with pins and vias, going on down
through the layer stack i.e. the way it's drawn) "Invisible" objects
come last. You can always do things like turn off visibilities, change
active layers, flip the view etc. to get to what you want.
It can be a trouble to select two overlapping objects if they're on the
same layer - you really need to zoom in to where you can click one while
being at least 5 pixels from the other.
