As for your question. You should be able to pull this off with the 
following filter functions:

<Or>
   <PropertyIsEqualTo>
     <Function name="isNull">
       <PropertyName>foo</PropertyName>
     </Function>
     <Literal>true</Literal>
   </PropertyIsEqualTo>
   <PropertyIsEqualTo>
     <Function name="strLength">
       <PropertyName>foo</PropertyName>
     </Function>
     <Literal>0</Literal>
   </PropertyIsEqualTo>
</Or>
