I don't recall licensing being a topic of conversation back then...

Browsing through e-mails, I don't seem any reference there either.  
Looking at colorbrewer.org, it seems it is now apache 2 licensed?

So either:

That's right, there is no "3".  The 4 conditions seem to apply to both 
licenses|...

2: fail -- uDig and GeoTools must add this to its docs then... but where?
