>topic off list<
Well, its too bad that you are this upset by a topic. This Is a list to
discus gerbils and the issues of shipping gerbils are on topic to this list.
>as we all know that views of shipping depends on the person. Don't get me
>wrong, I am not saying that this is right or wrong, but this is getting
>rediculious.<
NO no and no.
It is a FACT, *postal* shipping animals is ILLEGAL.
You can think its "ok" but its still not legal, just liek soem peopel will
say "smoking pot is ok" but if they are caught they will still very likely
be arrested and convicted.
>It is not illegal to ship livestock, yes folks, ANY LIVING THING THAT
>BREATHEWS EATS AND DRINKS THAT IS NOT HUMAN in the states. If you are
>shipping across borders thats different, but you can ship anywhere in
>the states.
It is true its not illegal to ship animals in the country enless the
state/city prohibts the species- for example, i can legally ship a gerbil
from illinois to ohio by driving it there or sendign it by delta dash (air
freight for animals)
What IS ILLEGAL are CERTAIN METHODS of shipping, one of which is POSTAL
SHIPPING.
>And further more, IF, IF it were illegal, they would not
>fine in excess of $1500.00. I don't know where the figures of hundreds
>of thousands are coming from<
It wasnt hundreds sorry, that was a type. it is TENS of thousands though
plus decades of jail time, or both! I don't make this stuff up, The figures
come from TITLE 18 of the UNITED STATES CODE 1716d. for mailing anything
unmailable under TITLE 39 UNITED STATES CODE 3015(a), (b) and (d). The
greatest amount posible for shipping nonmailables is $10000 or 20 years in
prision OR BOTH.
THIS ('title 18....') IS A FEDERAL LAW. The fines listed are quoted from
this.
Go to your school or city library and ask them how to look the law up if you
don't beleive me. You prolly can find it online too, but I havent the time
to search for it.
>, but mabe you should do a little more
>research before you start with figures of anysort.<
You really should practice what you preach and do soem research yourself
befor you scream foul at others who HAVE.
List for me what court transcripts and laws, specifically you have read that
reassure you with such certainity that *postal* shipping of rodents is
legal. If you were dragged off to court today after being discovered of
postal shipping, how would you defend yourself???
The postal service is subject to the restrictions in TITLE 18 of the UNITED
STATES CODE (federal law) which prohbits mailing matter that is outwardly or
of its own force dangerous to life, health or property.
The following quoted directly from the Hazardous, Restricted nd perishable
Mail Publication from the United States Postal Office, Publication #52, July
1999 which is a revision in accordance with the current standards of the
DOMESTIC MAIL MANUAL (DMM) c020-c024 and Title 18 of the United States Code
(federal laws)
211: GENERAL
Under 18 USC 1716, All mater that is outwardly or of its own force,
dangerous or injurious to life health or property is nonmailable. The
knowing deposit of such matter in the mail is punishable by fine,
imprisonment and/or other penalty....
525.2 LIVE WARM BLOODED ANIMALS

nonmailable:

526 MAILABLE LIVE ANIMALS
526.1 GENERAL

scorpions (only under limited circumstances) e. Other small harmless cold
blooded animals. f. Dead animals or parts of animals.
(NOTE FROM ME: the circumstances for scorpions is a) medical research and b)
for manufacture of anti-venom - AG)
>OH, and one more
>thing, stop with the gruesome stories of supposed trajedies with
>livestock. I think that this is just a feeble attempt for those against
>shipping to try and petrify those who are shipping to try to limit the
>access and supply of some gerbils.<
WHY woudl I want to limit peopel from access/supply? I share stories out of
CONCERN for the animals and the people involved. If you think that warning
peopel about the dangerous that could befall their animals is a "feeble
attempt to petrify" you have some serious growing up to do!
Do you think they show footage of car crash tests as well as of real crashes
caught on tape. just to "petrify" teenagers and scare them out of driving
and independance??? Oh yes this must be it- to torment new drivers- has
absolutely NOTHING to do with concern for their safety, LIVES or the health
and lives of innocent peopel around them.
If you tell peoepl NOT to share stories and warn people- then many more
peopel will repeate the same mistakes- resulting in more and more animals
suffering and dieying horribly. Is this what you want? Or do you want
people to be warned so that at the very least, they can consider the risks
and take precautions?
