First off, let me say I'm sorry for your loss. Your friend's family should really have taken action to close his e-mail account, and his brother should have changed the e-mail account associated with the xbox.
You can go through the help pages for recovering an account < http://support.google.com/accounts/bin/static.py?hl=en&ts=2402620&page=ts.cs> which includes an option for "I think someone else is using my account" but technically, so are you right now, so that may not work terribly well. If you get in, I'd suggest you immediately take action to not need access anymore, by setting a new e-mail against the xbox account and anything else that might be tied to it.
