I disagree with this.... The death penalty shouldn't be invoked until at 
least the third offence. First and second time offenders should just be 
tortured in varying degrees.

This I would agree with. Security is a process of code being written, code 
being exploited, exploit being publicized, code being fixed. Steve 
Northcutt said it best when her said "When you get hacked, and you WILL get 
hacked, tell everyone that you can so that as many people as possible can 
create a better security model".
