It is, and it was even under M1. We never enforced it back then, and they're still not right now. I've been hearing rumors of the new comcast merger impacting this kind of thing (in fact, I've heard they're going to attempt to find people running NAT), but we'll see what happens. As far as running a server goes, unless you're causing a problem (like running a DHCP server, which.. is now filtered by modem rules), they're not going to bother you. Serious bandwidth hogs catch some attention, but we couldn't ever do anything about them, really. The only people on the radar were people running quake servers, heavy mail servers, news servers, or offensive content web servers (child porn, unprotected regular porn, that kind of thing).
