i think the FSF would consider that non-free - the wording which would make it
non-free is very similar to the old unicode license, which according to the
parabola bug tracker, the FSF decided was non-free because of that wording

parabola has been patching ruby for 9 years, only to replace that one file with
the old unicode license

WRT this mailing list, i found only these two mentions of it; but neither had a
follow-up with a definitive decision
