This sounds ok then.

They must be making sure that only patches sent in that are
assigned to them are included with the software that they
release. This way they are free to also sell the software
under a different license. Of course, even GPLed software
could be sold under a different license if you got all the
contributors (copyright holders) to agree. In practice it
is too much work to track everyone down so it simply isn't
done - at least I haven't heard of a case of it being done..
